<p class="MsoNormal" style="text-align: justify; line-height: 200%; text-indent: -108pt; margin: 0cm 0cm 0pt 108pt"><span lang="EN-US" style="line-height: 200%; font-family: 'arial', 'sans-serif'; font-size: 11pt"><font color="#000000">DINO DI ROSA:<span style="mso-tab-count: 1">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span>No, I don&rsquo;t think there is one social media law as such but what the explosion of social media has done has to bring into focus, not only in law, but in politics and our social life and increasingly in the commercial world, a number of complex issues about rights and wrongs which have had and will have a tremendous impact on how people act and interact, sometimes for the better and as we have seen a lot of times for the worse.<o:p></o:p></font></span></p>

<p class="MsoNormal" style="text-align: justify; line-height: 200%; text-indent: -108pt; margin: 0cm 0cm 0pt 108pt"><span lang="EN-US" style="line-height: 200%; font-family: 'arial', 'sans-serif'; font-size: 11pt"><font color="#000000">DINO DI ROSA:<span style="mso-tab-count: 1">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;</span>Well, the first most obvious area of law that has been affected is privacy.<span style="mso-spacerun: yes">&nbsp; </span>Because of the internet and social media, there&rsquo;s almost no privacy anymore.<span style="mso-spacerun: yes">&nbsp; </span>People go on Facebook and talk about themselves and others and because of the speed with which people are able to do this and exchange the information, people&rsquo;s dirty laundry is not just aired down the local street as may have happened in the old days but potentially the whole world via the World Wide Web.<span style="mso-spacerun: yes">&nbsp; </span><o:p></o:p></font></span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 200%; text-indent: -108pt; margin: 0cm 0cm 0pt 108pt"><span lang="EN-US" style="line-height: 200%; font-family: 'arial', 'sans-serif'; font-size: 11pt"><o:p><font color="#000000">&nbsp;</font></o:p></span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 200%; margin: 0cm 0cm 0pt 108pt"><span lang="EN-US" style="line-height: 200%; font-family: 'arial', 'sans-serif'; font-size: 11pt"><font color="#000000">You will recall that a few months back we talked about the law of privacy mainly to do with governmental institutions.<span style="mso-spacerun: yes">&nbsp; </span>I explained then that Australian citizens do not have a general right to privacy as between themselves but with the advent of social media and its abuse at times this may change.<span style="mso-spacerun: yes">&nbsp; </span>Certainly, people can be prosecuted for cyber-stalking and restraining orders and things like that can be imposed on individuals but there&rsquo;s still no right to privacy as such. <o:p></o:p></font></span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 200%; margin: 0cm 0cm 0pt"><span lang="EN-US" style="line-height: 200%; font-family: 'arial', 'sans-serif'; font-size: 11pt"><o:p><font color="#000000">&nbsp;</font></o:p></span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 200%; text-indent: -108pt; margin: 0cm 0cm 0pt 108pt"><span lang="EN-US" style="line-height: 200%; font-family: 'arial', 'sans-serif'; font-size: 11pt"><font color="#000000">ALLAN BAIRD:<span style="mso-tab-count: 1">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>But the breach of privacy type cases can cross over into defamation cases, can&rsquo;t they, and I suppose Facebook and MySpace and other sites have been used to produce defamatory material.<o:p></o:p></font></span></p>

<p class="MsoNormal" style="text-align: justify; line-height: 200%; text-indent: -108pt; margin: 0cm 0cm 0pt 108pt"><span lang="EN-US" style="line-height: 200%; font-family: 'arial', 'sans-serif'; font-size: 11pt"><font color="#000000">DINO DI ROSA:<span style="mso-tab-count: 1">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span>Yes, the internet is just like any other form of media, it can be used, either deliberately or inadvertently, to publish material about other individuals which a Court may later deem defamatory.<span style="mso-spacerun: yes">&nbsp; </span>There was the case a couple of years ago, in Kadina, which was believed to be the first Facebook defamation case in Australia, when a young man made some really offensive comments about one of the local coppers.<span style="mso-spacerun: yes">&nbsp; </span>The officer found out about the lad&rsquo;s rant and the lad was prosecuted for criminal defamation.<o:p></o:p></font></span></p>

<p class="MsoNormal" style="text-align: justify; line-height: 200%; text-indent: -108pt; margin: 0cm 0cm 0pt 108pt"><span lang="EN-US" style="line-height: 200%; font-family: 'arial', 'sans-serif'; font-size: 11pt"><o:p><font color="#000000">&nbsp;</font></o:p></span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 200%; margin: 0cm 0cm 0pt 108pt"><span lang="EN-US" style="line-height: 200%; font-family: 'arial', 'sans-serif'; font-size: 11pt"><font color="#000000">As with all media, social media is more than one way.<span style="mso-spacerun: yes">&nbsp; </span>Once feared by employer, social media has become a useful tool in the workplace, such as recruiting new staff, marketing or even client development.<span style="mso-spacerun: yes">&nbsp; </span>But when used by employees, not necessarily during working day but out of hours, it can have detrimental effects. There was a case in Fair Work Australia a little while ago, where an employee posted a disparaging comment about his employer on his Facebook page from his computer outside of work hours, using a lot of four letter words in his tirade which would have been read by only about 70 of this fellows Facebook &ldquo;friends&rdquo; in inverted commas, and not by the boss who was not an habitual user of Facebook and certainly not a &ldquo;friend&rdquo; in inverted commas.&nbsp;&nbsp; Well of course the boss found out about it and dismissed the trash talking employee who of course sued the employer for unfair dismissal.<span style="mso-spacerun: yes">&nbsp; </span><o:p></o:p></font></span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 200%; margin: 0cm 0cm 0pt 108pt"><span lang="EN-US" style="line-height: 200%; font-family: 'arial', 'sans-serif'; font-size: 11pt"><o:p><font color="#000000">&nbsp;</font></o:p></span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 200%; margin: 0cm 0cm 0pt 108pt"><span lang="EN-US" style="line-height: 200%; font-family: 'arial', 'sans-serif'; font-size: 11pt"><font color="#000000">In rejecting the worker&rsquo;s claim, and finding for the employer, the judge took the view that it did not matter that the statements were made outside of the workplace and not necessarily to other workers.<o:p></o:p></font></span></p>

<p class="MsoNormal" style="text-align: justify; line-height: 200%; margin: 0cm 0cm 0pt 108pt"><span lang="EN-US" style="line-height: 200%; font-family: 'arial', 'sans-serif'; font-size: 11pt"><font color="#000000">But by the same token there have been numerous cases in the Courts where the parties have been cross-examined about their actions outside of the Court room, where they play the dutiful, righteous spouse or parent in Court and are then shown something horrible or unappealing that they have said or done on Facebook.<span style="mso-spacerun: yes">&nbsp; </span><o:p></o:p></font></span></p>

<p class="MsoNormal" style="text-align: justify; line-height: 200%; margin: 0cm 0cm 0pt 108pt"><span lang="EN-US" style="line-height: 200%; font-family: 'arial', 'sans-serif'; font-size: 11pt"><font color="#000000">There was the case of a woman who operated a twitter account called &ldquo;sexytiger77&rdquo; with a suggestive photograph of her alongside her nom and the evidence was that she used the account to solicit for the purpose of prostitution.<span style="mso-spacerun: yes">&nbsp; </span>She had a young child who had access to her computer and this evidence had a very adverse impact on her claim to have exclusive care of her child.<o:p></o:p></font></span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 200%; margin: 0cm 0cm 0pt 108pt"><span lang="EN-US" style="line-height: 200%; font-family: 'arial', 'sans-serif'; font-size: 11pt"><o:p><font color="#000000">&nbsp;</font></o:p></span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 200%; margin: 0cm 0cm 0pt 108pt"><span lang="EN-US" style="line-height: 200%; font-family: 'arial', 'sans-serif'; font-size: 11pt"><font color="#000000">There was another interesting case a year or so ago where a Chinese woman was able to use Facebook to prove that her husband had already been married to another woman at the time she married him.<span style="mso-spacerun: yes">&nbsp; </span>She was able to get the Court to annul the marriage on the ground of bigamy, which wasn&rsquo;t big of him, was it?<span style="mso-spacerun: yes">&nbsp; </span><o:p></o:p></font></span></p>

			<content:encoded><![CDATA[<p>It&#8217;s Christmas time when families get together all around Australia to spend quality time with each other in a spirit of giving and sharing.  Sadly, not all families are together at this time of the year, especially in situations where there have been breakdowns of relationships.  Children often suffer the most in this situation.  Here is a transcript of an interview between Allan Baird and Dino Di Rosa on Allan&#8217;s 88.7 Coast FM Thursday Drive program last night.  An audio version of the talk will appear in the blog in the next few weeks.  Merry Christmas and have a Happy New Year.</p>
<div style="line-height: 200%; text-indent: -144pt; margin: 0cm 0cm 0pt 144pt;"><strong><span style="line-height: 200%;">ALLAN BAIRD:                               It’s Christmas time and this should be the time when families get together and enjoy each other’s company in a spirit of giving and sharing. Sadly, a lot of families are not necessarily <span style="text-decoration: underline;">all</span> together at this time, especially when it comes to separated parents and the time they spend with their children. </span></strong></div>
<div style="line-height: 200%; text-indent: -144pt; margin: 0cm 0cm 0pt 144pt;"><strong><span style="line-height: 200%;">                                                         </span></strong><strong><span style="line-height: 200%;">Today, prompted by questions from some of our listeners, Dino is here to answer questions about parenting and children’s issues at Christmas time. It doesn’t have to be all bad news as I am sure Dino will explain.</span></strong></div>
<div style="line-height: 200%; text-indent: -144pt; margin: 0cm 0cm 0pt 144pt;"><strong><span style="line-height: 200%;">                                                          </span></strong><strong><span style="line-height: 200%;">The first question is from Sandra of Prospect, who asks what do the Family Courts consider when deciding of which parent gets access to their child during special occasions such as Christmas.</span></strong></div>
<div style="line-height: 200%; text-indent: -144pt; margin: 0cm 0cm 0pt 144pt;"><span style="line-height: 200%;">DINO DI ROSA:                                Well, first of all, the terminology has long changed. In previous times a parent either had “custody” of a child or children and the other parent had “access” to the child or children. Nowadays, one parent often will have the child or children “live with” them, and the other party will “spend time” with that child or those children. </span></div>
<div style="line-height: 200%; margin: 0cm 0cm 0pt 144pt;"><span style="line-height: 200%;">The first thing the court considers is what is in the best interests of the child. The law says that the best interests of the child are the paramount consideration. It also says that a child is to be protected from violence or abuse and that as far as is possible, a child should be able to have a relationship with both parents.</span></div>
<div style="line-height: 200%; text-indent: -144pt; margin: 0cm 0cm 0pt 144pt;"><strong><span style="line-height: 200%;">ALLAN BAIRD:                             So let’s assume family violence and conflict are not really in issue, what do the Courts have to consider at this time of year?</span></strong></div>
<div style="line-height: 200%; text-indent: -144pt; margin: 3.75pt 0cm 6pt 144pt;"><span style="line-height: 200%;">DINO DI ROSA:                             Even when family violence and conflict are not an issue, the Christmas period can still be a very emotive time for those parents dealing with a family breakdown or separation, sometimes even years down the track. </span></div>
<div style="line-height: 200%; margin: 3.75pt 0cm 6pt 144pt;"><span style="line-height: 200%;">The Family Law Act 1975 was amended some years ago now to include mandatory requirements for parents to attempt to resolve parenting matters through family dispute resolution services before applying to the Family Law Court (&#8220;the Court&#8221;) for a Parenting Order. </span></div>
<div style="line-height: 200%; margin: 3.75pt 0cm 6pt 144pt;"><span style="line-height: 200%;">If an agreement is reached during the dispute resolution phase the parties can apply to the Court for the agreement to be made into a Parenting Order. If no agreement is reached by the parties during the dispute resolution phase then an application may be made to the Court for a Parenting Order.</span></div>
<div style="line-height: 200%; margin: 3.75pt 0cm 6pt 144pt;"><span style="line-height: 200%;">Happily I would think that the majority of cases are decided between separated parents without the intervention of the Court.</span></div>
<div style="line-height: 200%; margin: 0cm 0cm 0pt 144pt;"><span style="line-height: 200%;">The most common holiday arrangement is that each parent has a child for half of the holidays, alternating each year between the first and the second half, but it really depends on the facts of each case. </span></div>
<div style="line-height: 200%; text-indent: -144pt; margin: 0cm 0cm 0pt 144pt;"><strong><span style="line-height: 200%;">ALLAN BAIRD:                               One of our country listeners asks: What if the parties live some distance apart, say one lives in the country and one in the city or they live in separate states?</span></strong></div>
<div style="line-height: 200%; text-indent: -144pt; margin: 0cm 0cm 0pt 144pt;"><span style="line-height: 200%;">DINO DI ROSA:                               Problems are more likely to arise when there is a distance factor, which might make a split holiday impractical. Usually the only realistic solution is that each year the child spends Christmas with just one parent on an alternating basis.</span></div>

<div style="line-height: 200%; margin: 0cm 0cm 0pt 144pt;"><span style="line-height: 200%;">It’s not ideal, but what can you do? The Court recognises that we do not live in a perfect world but as I have said it is there to serve the best interests of the child, not the wishes or conveniences of the parents.</span></div>

<div style="line-height: 200%; text-indent: -5cm; margin: 3.75pt 0cm 6pt 5cm;"><strong><span style="line-height: 200%;">ALLAN BAIRD:                             You mentioned a parenting order. What is a Parenting Order?</span></strong></div>
<div style="line-height: 200%; text-indent: -5cm; margin: 3.75pt 0cm 6pt 5cm;"><span style="line-height: 200%;">DINO DI ROSA:                             A Parenting Order is an order from the Court dealing with the following issues:</span></div>
<div style="line-height: 200%; margin: 3.75pt 0cm 6pt 5cm;"><span style="line-height: 200%;">1. The person(s) with whom the child is to live;</span></div>
<div style="line-height: 200%; margin: 3.75pt 0cm 6pt 5cm;"><span style="line-height: 200%;">2. The time the child is to spend with another person(s); and</span></div>
<div style="line-height: 200%; margin: 3.75pt 0cm 6pt 5cm;"><span style="line-height: 200%;">3. The allocation of parental responsibility for the child.</span></div>
<div style="line-height: 200%; text-indent: 2.25pt; margin: 3.75pt 0cm 6pt 5cm;"><span style="line-height: 200%;">A Parenting Order will generally set out the times and dates that each parent will spend with the child during special holiday periods such as Christmas in order to minimise the possibility of conflict during these periods.</span></div>
<div style="line-height: 200%; margin: 3.75pt 0cm 6pt 5cm;"><span style="line-height: 200%;">A Parenting Order can also allow for time for the children with grandparents and other members of the extended family with the Court taking into account the relationship between the child and the grandparents and the likely effect that separation from a grandparent will have on a child.</span></div>
<div style="line-height: 200%; text-indent: -5cm; margin: 3.75pt 0cm 6pt 5cm;"><strong><span style="line-height: 200%;">ALLAN BAIRD:                             What happens if one party doesn&#8217;t comply with a Parenting Order?</span></strong></div>
<div style="line-height: 200%; margin: 3.75pt 0cm 6pt 5cm;"><span style="line-height: 200%;">When a Parenting Order has been made each person affected by the order needs to follow the order. </span></div>
<div style="line-height: 200%; margin: 3.75pt 0cm 6pt 5cm;"><span style="line-height: 200%;">Non-compliance with a Parenting Order over the Christmas period is problematic as it is a time when parents will find it difficult to access legal services for advice on how to handle the situation. The Family Law Courts are aware of conflicts that may arise at this time of year which is why it sets a deadline for applications for parenting orders relating to time at Christmas in mid-November and will not generally hear so-called urgent applications after that date unless they are truly urgent or in the best interests of the children.</span></div>
<div style="line-height: 200%; text-indent: -5cm; margin: 3.75pt 0cm 6pt 5cm;"><strong><span style="line-height: 200%;">ALLAN BAIRD:                             How can parents avoid conflict and having the Family Courts decide their case for them?</span></strong></div>
<div style="line-height: 200%; text-indent: -5cm; margin: 0cm 0cm 12pt 5cm;"><span style="line-height: 200%;">DINO DI ROSA:<strong>                            </strong></span><span style="line-height: 200%;">The simplistic answer is for the parents to be as child-focussed as they possibly can and not to think about their former spouse or their own individual interests.   It’s not about one parent “losing” and “letting the other parent win” as I have heard clients say so many times over the years. As both parents have an interest in the children’s wellbeing, compromise must be made somewhere. </span></div>
<div style="line-height: 200%; margin: 0cm 0cm 12pt 5cm;"><span style="line-height: 200%;">The smartest thing to do when planning Christmas is to make arrangements early.  Plan ahead. Think about what is going to happen year in year out beforehand and try to get your agreement in writing in the form of a Parenting Plan, at the very least, which does not involve the Courts, or a Parenting Order, if you have to take it to Court even if you reach an agreement at the door step of the Court.</span></div>
<div style="line-height: 200%; margin: 0cm 0cm 12pt 5cm;"><span style="line-height: 200%;">A verbal agreement between parents can be hard to prove down the track if one parent is forgetful.  Agreement by email or texting is one step better.  And the Family Courts will certainly have regard to agreements that have been made in the past and in particular arrangements that have been made and carried through in the past, because the Family Courts will always err on the side of caution when it comes to children and look to the status quo, ie keeping things as they are or have been in the past, if that is in the best interests of the child.</span></div>
<div style="line-height: 200%; margin: 0cm 0cm 12pt 5cm;"><span style="line-height: 200%;">However, while I have been advocating the implementation of a parenting plan, which is essentially a signed and dated written record of agreed parenting arrangements, a Parenting Plan is not enforceable in itself but must be considered by a Court if an application for Orders is made.  Court Orders are enforceable and provide the best protection for Christmas times and other times you intend to spend with your children.  If you cannot reach an agreement privately, or through mediation, or with your respective lawyers, then going to the Family Courts may be your only solution but be prepared and be early!</span></div>

<p class="MsoNormal" style="margin: 0cm 0cm 10pt"><span style="line-height: 115%; font-family: 'arial', 'sans-serif'"><font color="#000000"><span _fck_bookmark="1" style="display: none">&nbsp;</span><span _fck_bookmark="1" style="display: none">&nbsp;</span>After 1 July 2008, the Family Law Act changed to allow parents to enter into a Binding Child Support Agreement.<span style="mso-spacerun: yes">&nbsp; </span></font></span><span style="line-height: 115%; font-family: 'arial', 'sans-serif'; font-size: 12pt"><font color="#000000"><o:p></o:p></font></span></p>
<p class="MsoNormal" style="text-align: justify; margin: 0cm 0cm 10pt"><span style="line-height: 115%; font-family: 'arial', 'sans-serif'"><font color="#000000">They are intended to provide a level of certainty and finality about child support arrangements for parents.<span style="mso-spacerun: yes">&nbsp; </span>Therefore legal advice is required to ensure that parents understand the consequences of making a Binding Child Support Agreement and to provide protection against any misleading behaviour.<span style="mso-spacerun: yes">&nbsp; </span>Furthermore, they must also receive legal advice before terminating the Agreement.<span style="mso-spacerun: yes">&nbsp; </span></font></span><span style="line-height: 115%; font-family: 'arial', 'sans-serif'; font-size: 12pt"><font color="#000000"><o:p></o:p></font></span></p>
<p class="MsoNormal" style="text-align: justify; margin: 0cm 0cm 10pt"><span style="line-height: 115%; font-family: 'arial', 'sans-serif'"><font color="#000000">It is not necessary to have an administrative assessment in force before entering the Agreement however if a Binding Agreement is registered with the Child Support Agency a &ldquo;notational&rdquo; formula assessment will be created.<span style="mso-spacerun: yes">&nbsp; </span>A notational assessment is the formula based assessment that would apply if the Agreement was <u>not</u> in place.<span style="mso-spacerun: yes">&nbsp; </span>However, where the Binding Agreement provides for crediting of a &ldquo;lump sum payment&rdquo; certain provisions must be made.<span style="mso-spacerun: yes">&nbsp; </span></font></span><span style="line-height: 115%; font-family: 'arial', 'sans-serif'; font-size: 12pt"><font color="#000000"><o:p></o:p></font></span></p>
<p class="MsoNormal" style="text-align: justify; margin: 0cm 0cm 10pt"><span style="line-height: 115%; font-family: 'arial', 'sans-serif'"><font color="#000000">The Binding Agreement must contain a statement that each party obtained independent legal advice before the Agreement was signed and each party&rsquo;s solicitor certifies in an Annexure to the Agreement that they have provided independent legal advice.<span style="mso-spacerun: yes">&nbsp; </span></font></span><span style="line-height: 115%; font-family: 'arial', 'sans-serif'; font-size: 12pt"><font color="#000000"><o:p></o:p></font></span></p>
<p class="MsoNormal" style="text-align: justify; margin: 0cm 0cm 10pt"><span style="line-height: 115%; font-family: 'arial', 'sans-serif'"><font color="#000000">It is important to note that the Binding Agreement can provide for the payment of child support that is less than, equal to or more than the rate of child support that would be payable under the formula assessment.<span style="mso-spacerun: yes">&nbsp; </span>The Agreement will not be sent to Centrelink for approval unless the Agreement includes the period that is prior to 1&nbsp;July 2008.<span style="mso-spacerun: yes">&nbsp; </span></font></span><span style="line-height: 115%; font-family: 'arial', 'sans-serif'; font-size: 12pt"><font color="#000000"><o:p></o:p></font></span></p>
<p class="MsoNormal" style="text-align: justify; margin: 0cm 0cm 10pt"><span style="line-height: 115%; font-family: 'arial', 'sans-serif'"><font color="#000000">Furthermore, it can provide for periodic, non periodic and lump sum payments.<span style="mso-spacerun: yes">&nbsp; </span></font></span><span style="line-height: 115%; font-family: 'arial', 'sans-serif'; font-size: 12pt"><font color="#000000"><o:p></o:p></font></span></p>
<p class="MsoNormal" style="text-align: justify; margin: 0cm 0cm 10pt"><span style="line-height: 115%; font-family: 'arial', 'sans-serif'"><font color="#000000">The Binding Agreement can be terminated by executing a Termination Agreement or a further Binding Child Support Agreement.<span style="mso-spacerun: yes">&nbsp; </span>However, both alternatives do require the provision of independent legal advice to each of the parents.<span style="mso-spacerun: yes">&nbsp; </span></font></span><span style="line-height: 115%; font-family: 'arial', 'sans-serif'; font-size: 12pt"><font color="#000000"><o:p></o:p></font></span></p>

<p><span style="font-size: 12px"><span style="line-height: 115%; font-family: 'arial', 'sans-serif'"><font color="#000000">It is important to mention that the Agreement can also be set aside by the Court in very limited circumstances therefore it is very important for each party to receive comprehensive independent legal advice before entering into a Binding Child Support Agreement. </font></span></span></p>

<p class="MsoNormal" style="text-align: justify; margin: 0cm 0cm 10pt"><span style="line-height: 115%; font-family: 'arial', 'sans-serif'; font-size: 12pt"><font color="#000000">Of course, the perennial story seems to be that the WorkCover system has a massive unfunded liability which does not seem to have been effectively addressed by the changes that were introduced in 2008.<span style="mso-spacerun: yes">&nbsp; </span><o:p></o:p></font></span></p>
<p class="MsoNormal" style="text-align: justify; margin: 0cm 0cm 10pt"><span style="line-height: 115%; font-family: 'arial', 'sans-serif'; font-size: 12pt"><font color="#000000">Those changes had some potentially wide-ranging effects on injured workers in particular.<span style="mso-spacerun: yes">&nbsp; </span>Perhaps the most serious of those changes was the introduction of a 130 week (2.5 year) limit on the receipt of income maintenance payments.<span style="mso-spacerun: yes">&nbsp; </span><o:p></o:p></font></span></p>
<p class="MsoNormal" style="text-align: justify; margin: 0cm 0cm 10pt"><span style="line-height: 115%; font-family: 'arial', 'sans-serif'; font-size: 12pt"><font color="#000000">However, there were also changes to other aspects of the WorkCover system.<span style="mso-spacerun: yes">&nbsp; </span>An important one of those was to limit the amount of fees that a lawyer can charge an injured worker.<span style="mso-spacerun: yes">&nbsp; </span><o:p></o:p></font></span></p>
<p class="MsoNormal" style="text-align: justify; margin: 0cm 0cm 10pt"><span style="line-height: 115%; font-family: 'arial', 'sans-serif'; font-size: 12pt"><font color="#000000">What this means is, that in effect, much of the work of a lawyer on behalf of an injured worker, cannot be charged directly to the worker and can only be charged to WorkCover.<span style="mso-spacerun: yes">&nbsp; </span>This means that an injured worker can now have a great deal more confidence about consulting with a lawyer in relation to their claim and not have to worry about expensive legal fees wiping out any financial benefit that they might otherwise obtain through using a lawyer.<span style="mso-spacerun: yes">&nbsp; </span><o:p></o:p></font></span></p>
<p class="MsoNormal" style="text-align: justify; margin: 0cm 0cm 10pt"><span style="line-height: 115%; font-family: 'arial', 'sans-serif'; font-size: 12pt"><font color="#000000">The vast majority of injured workers who lodge a claim with the WorkCover system do not need a lawyer.<span style="mso-spacerun: yes">&nbsp; </span>However, there are almost always circumstances where legal assistance can be of benefit.<span style="mso-spacerun: yes">&nbsp; </span><o:p></o:p></font></span></p>
